I think the confusion on my part must have been the language used when initially discussing this with him. I knew about the necessity of a written notice before hand and the reason I hadn't gone that route was because it wasn't my intention to tell him to leave and especially on such short notice. The final conclusion of our talk was that he was going to improve how he acted and intended on staying, I agreed to this. My goal was to leave the decisions up to him on how he proceeded


When it comes to a deposit that was a product of researching the differences between that and a last month rent before getting into this. I assume my mistake would have been researching it more broadly rather than specifically looking at Florida law? I had seen that deposits were for damages and repairs but that an advanced rent could be used upon request of the tenant to cover their final month of renting before it arrived. Unless Florida handles these both similarly as you've mentioned then I had been completely lead to believe that they were separate entities.
