    Default Can You Avoid Repaying Relocation Assistance if You Resign

    I was relocated for my current company and have been offered a position at a different company. I signed a form that I would have to pay it back 100% if you leave before 6 months and 50% if you leave the company after 6 months. If I accept this other position its less than 30 days until my 1 year contract is up. Do you think they will make me pay it back?

    But if they do decide to sue you for it, you will probably lose. (And the likelihood of them suing may depend in large part on the amount of money they'd be going after. How much money are talking about here?)

    The total amount was $6,000 so I would have to pay back 3,000...

    This is a very large company (also retail) so I don't know that they would come after me for that amount. Plus my year would be up in less than 20 days.

    The "accepted" standard is to give two weeks notice when leaving a job, if you have less then 3 weeks left wouldn't it be worth $3k to just give a 3wk notice and start the new job a few days later? Then there is no issue.

    Agree with yyz0.

    And if your new employer won't allow for three weeks' notice, tell him/her that you're on the hook for $3K if you leave any sooner. I've seen new employers pay this sort of thing (relo assistance, hiring bonuses, tuition reimbursement etc.) in order to acquire highly desirable new employees. But remember, then you'll be on the hook to your new employer for that $3K.

    (And regarding $3K being too small for your employer to sue you for? Actually it's not. Every large employer I've ever worked for would definitely go after $3K. All your employer has to do is file a small claims court action against you. Your employer won't need an attorney, will be out only about a half day's work for the manager it sends to court, plus some small filing fee. Which can be added to the claim against you, so you'll end up paying that too, in addition to the $3K.

    I agree with the others that you either wait the 3 weeks OR you ask the new employer to pay that amount. I honestly can't imagine the new employer not being willing to back up your start date by a few weeks rather than either of you paying the $3k!

    I've personally seen more than a few employers pay up to $10K-worth (and in one case $25K) of employee debt to acquire certain highly-desirable employees. It happens - but most commonly in the area of tuition reimbursement (for example ER A pays for EE's Exec MBA program with a firm contract that EE must repay the cost of the program if EE leaves within one year, and ER B wants a newly-minted MBAer so agrees to pay off EE's MBA program debt if EE agrees to go work for ER B immediately upon completing the program - employers actually monitor these programs to see if there are any people in them that they might want to "buy" upon graduation). But I have seen it happen with relo assist debt too.
