    Unhappy Will Resigning from a Prior Job Affect Your Eligibility for Unemployment

    My question involves labor and employment law for the state of: NY

    I had a decent job in a large company in NY however I was looking to grow faster. I was offered a job at a mid size company with a better pay and a promise of a great future. After giving notice and 2 weeks to my job I started working in 2nd job. I was very happy and so were my Bosses and managers. Today I got called in and was told they are rearranging the company and thry can afford to keep me. Now I am jobless. I worked at my 1st job for over 2 years and at the new job for about 3 month. Can I apply for UI in NYS since I quit my !st job? Do they consider my work at the 1st job as part of the 5Q calculation even if I quit or because I was let go now they take everything in consideration.

    You can always apply.

    There are two prongs to unemployment eligibility. One is whether you qualify financially; the other is whether you are without a job for a qualifying reason. While all jobs you've had in the past five quarters count for the first prong, only the second job will count for the second.

    NY requires that your work 3 days a week for 5 weeks and earn 10 times your weekly benefit amount to purge a potential quit disqualification. You did. Save your paystubs. It'll really speed things up if your employer is slow reporting wages, or you get a picky UI worker.

    Chyvn, Sorry I dont understand. on both jobs I worked more then 3 days for 5 weeks and earned around 1200 gross a week. The 1st job I quit in order to take the 2nd job the 2nd job I worked about 3 month and was let go. My understanding is the income is qualified from both jobs but will the fact that I quit from my 1st job consider my case as quitting or will the being let go from 2nd job be the factor and then qualify?

    It can, that's why the 3 days for 5 weeks . . . . Because you did that, it doesn't matter why you quit the 1st job. However, there's a chance that the 2nd job didn't report your wages yet. When NY goes poking around, they might think you quit, and did NOT work long enough on the 2nd job. You need to know that so you can clue them in with paystubs so you get your benefits a lot easier.
