    Default H1 Visa Woes

    My girlfriend is trying to get an h1 through her company. She is a Korean citizen but has gone to school in ny. She is working in Manhattan and has a great job. Her lawyer told her that because her company filed a loss for 2004 on their tax returns, the government would reject her application. Does this make sense? We have been going through an emotional hell with her getting a job at a company that would sponsor her and the visa process. Any thoughts or recommendations aside from marraige would be much appreciated.

    Default H1-B Sponsor Took Loss on Taxes

    If the prospective employer is going to petition for the visa anyway, you can wait and see what happens. Beyond that, she would need to keep looking for potential employers willing to sponsor her.

    Thankyou aaron,
    She has to handle the application on her own. She is paying for the lawyer and application fees. Her OPT period has expired already so if her application is not accepted, she will have to get an I-20 and go to school while looking for another job.
