If you simply talk to her and she sends you a photo of her that is not sexual in nature, as stated, there's nothing illegal. But why are you 21 dating a 16 year old? You can't find anyone your own age who is an adult? Do her parents know? Oh and I hope you aren't having sex with her because Oregon's age of consent is 18.
Maybe read this: http://mobilemediaguard.com/states/s...ws_oregon.html
Currently in the State of Oregon, anyone - regardless of Oregonage - who creates, distributes or possesses an image of a minor engaged in a sexually explicit act may be prosecuted under the State’s child pornography laws and if convicted, may be incarcerated and will need to register as a sex offender. Recently, legislation was proposed in the Oregon State Senate that would reduce penalties for minors caught sexting.
Until the proposed sexting bill becomes law or another similar type bill were to become law, minors who are caught sending, receiving or taking images of a minor engaged in sexually explicit activities can be prosecuted under the State’s child pornography laws.
I don't know how old this is or if anything has changed since 2011 when that bill was introduced. But if your "girl" sends you any nude photos SHE can be charged with child pornography possession as much as you. Unless something has changed.
It must not have because here's this guy's story: http://www.ktvz.com/news/central-ore...rever/68597646
That was in 2014 and also stated this: That's what a new law is supposed to change. It was passed last year and went into effect in mid-January.
House Bill 2549 creates a new three-tiered registration system based on an offender's risk and directs more attention to the highest-risk group.
Oregon seems to be pretty strict about age of consent with minors and with sexting nude images. So if I was you I would consider not just your future but your "girl's" future. Because if she sends you a photo she can get in trouble too.
