    Default Can a Landlord Force You to Move Out Without Evicting You

    In October 2016, I renewed my lease for another year. Last week I attempted to have my fiancé added to my lease. However, his application was denied due to failing the credit check. Approximately 4 days later I received a call from the property manager stating that I have 30 days to move out, because it is too much of a risk that I will still move him into my apartment.

    Later that day, I visited the office. I was informed that I was not being evicted. However, I would be required to pay two months of rent and forfeit my deposit. This did not seem right to me, as I am not choosing to abandon by apartment or terminate my lease. Additionally, I have not received anything in writing saying that I must leave my apartment. I asked the property manager about a specific move out date, and she has been unable to provide one. I was told by another leasing consultant that this decision is policy, and employees are trained to tell tenants something similar in this situation. Additionally even if my fiancé never steps foot on the property again, I am still required to leave.

    Although my fiancé is here almost daily, either visiting or spending the night, this is not his residence and no mail or anything else comes here in his name. He lives in a home with a relative several miles away. No bills are registered in his name. I'm sure the leasing office and other tenants see him quite frequently, but it was never stated that they assumed he lived here, just that my staying is too much of a risk. Lastly, I have always paid my rent on time and tried my best to abide by all of the lease rules and policies. My fiancé is never here at the apartment, unless I am here as well. Can my landlord force me to leave in 30 days, because my fiancé failed a credit check? It has been about a week since his application and I have still received nothing in writing and heard nothing more about the issue from the leasing office. At this point, I'm not even preparing or considering moving because I feel they have no legal basis for this action. I reside in Georgia.
