    Default Does Your Employer Need Your Consent to Take Your Picture at Work

    My question involves labor and employment law for the state of: Utah

    I work for a retail company and my district manager takes photos of bad examples of things and uses them in a slideshow presentation at the annual manager meetings to basically have a laugh. Photos include botched mannequins, incorrect window displays, and other things that can go wrong in retail. Today I found out that she included a photo of me in my workplace, which I did not have any knowledge of her taking. She also did not ask for my permission before taking the photo or using it in her slideshow, where she and other members of upper management essentially made fun of me at a corporate sponsored event. I was wondering what my rights were in regards to this sort of situation and what legal grounds the company has to use my photo in a demeaning way without my knowledge or consent.

    Unfortunately what she did is likely legal, even if it displays very poor management skills. In general there is no requirement for a photographer to get permission from a person prior to taking his or her photograph. If the manager had a right to stand where she was at the time she took the photo then she was also allowed to take photos of anything she could see from that location so long as it was not a place like a bathroom or dressing room. Permission is needed from a subject of a photo prior to making certain kinds of use of a photo of a person who is recognizable in the photograph. For example, a photographer who makes commercial use of a photograph of a person (e.g. sells it for use in advertising, etc) runs the risk of being sued by the person in the photograph for violating the person’s right to control his/her image for publicity. But using the photo at a company annual meeting is not a use that would generally violate any rights that you have and so the manager would not have needed your permission for it.
