    Default Roommate Wants To Leave

    I live in New York City and my roommate and I entered into a 1 year lease together (we are both on the lease). She now wants to move out but we have not found a replacement for her yet. The New York City Rent Guidelines say that in order for a person to sublet an apartment they must submit to the landlord in writing 30 days before wanting to move out:

    - the term of the sublease
    - the name of the proposed sublessee
    - the business and permanent home address of the proposed sublessee
    - the reason for the sublet request
    - your address for the term of the sublease
    - written consent from any co-tenant or guarantor on the lease
    - a copy of the proposed sublease (along with a copy of your lease, if available) acknowledged by the tenant and subtenant as a true copy of the sublease

    Given this information, am I correct to assume that she needs my written consent to move out and if she does so without this consent, then I can hold her liable for continuing to pay the rent. I want to make sure that I am reading things correctly and that there are no other guidelines governing this situation which might change things. Thanks for the help.

    If you're asking if you have an absolute veto over a new roommate, I expect you'll find that your refusal of a replacement roommate must be reasonable. Got a link or a citation to that rule, btw?

    Thanks for the reply. Basically I have no problem with someone else moving in but I want to get along with that person. I do not want to be forced to live with someone who might not be compatable just because my roommate wants to move out.

    I think it is rent stabilized but not rent controlled. I am not sure what the difference is, but I think that is how it is characterized.
