My question involves criminal law for the state of: Kentucky
Last Night I was working at my local gas station from 10pm to 6am, supposedly I fell asleep from 1:48 - 2:20. Things were slow and I sit down to take a break, I work the store alone in a small town at night. I honestly didn't remember falling asleep. I got a call a couple of hours ago that they have on camera me falling asleep and two customers coming into the store stealing some items (1x cigs, 1x mountain dew and that's what they could see). Like I said I don't remember but now they want to charge me with Complicity in theft because I fell asleep and unless I want to be charge with the crime I need to sign over my next to pay checks. Apparently I've already been fired at this point. They showed me the footage from last night and it shows me cleaning then me going to the part of the store with no cameras from 1:48 - 2:20. Nothing shows me that they have footage of me sleeping and during the meeting between the manager and I (I recorded the Conversation) she stated that I was last seen on camera from those times and that when customers came in and stole. The police are already involved into the situation but no charges so far. I have until 7 am to decide wither to sign my money away for get charges.
A couple of questions;
1. Should I sign my checks over and avoid court. (I have a family, three kids and a wife)
2. Do I have a guarantee that they still wont take me to court if I give them my money?
3. Can I press charges on them or sue them for extortion? and collect emotion damages?
4. do they have any legal standing for an arrest warrant or charges at all?
I understand KY is not a right to work state and I can be fired for any reason besides based on religious, gender or things like that so i can't collect monetary damages besides court cost if they lose.
FYI: I am a US Army (military police) combat veteran, I have two degree AS in criminology and BS in project management in the process of testing for my local Sheriffs department.
