    Default Can You Get Unemployment Insurance if Your Employer Isn't Giving You Job Assignments

    My question involves labor and employment law for the state of: Virginia (Federal employee)

    I am a full time permanent career federal employee on what is called a flex tour schedule.

    I am obligated to work a minimum number of days per year, based on an availability schedule that I provide. I made myself available the first of the month, and my supervisor has no assignments for me and doesn't anticipate any for a few weeks. I am in an unpaid status. I have some leave on the books but I am not permitted to take it, since I'm not in a paid status.

    Eligible for unemployment? I'm going to file and see what they say but I thought I'd ask and see what you guys think. Never had to do this before. Thanks.

    Unless there are special rules for Federal employees, I don't see why you wouldn't be.

    It will be a federal claim, which means it will take a little time to get set up, but yes, you should, if you have enough wages in the appropriate quarters to set up monetarily, qualify for a claim, and be able to draw unemployment benefits from that claim for any week that they do not have work for you that you are fully able and available to do. I'm not sure I understand the situation of "making myself available" that you mention, but your eligibility monetarily will depend on the wages you have in covered quarters going back about the last 18 months, and the fact that they do not have work available to you so that you are out of work through no fault of your own. Don't act as though this was signing up for welfare. Unemployment benefits are not based on your income or your need for them, they will ask no income questions, and it's not something you should be ashamed to do. There is no downside to filing the claim, you either will or will not be able to draw benefits.

    Appreciate the comments.

    I'm in a pool of relief personnel and we give them availability dates via an online schedule, if that helps. I worked about half of last year. Usually we get assignments pretty quickly. I've not been this long without one once my availability begins.

    We were allowed to file during the shutdown in 2013. I didn't because by the time I was considering it, we were back at work.

    I'll file, the worst they can say is no or I'll get an assignment shortly thereafter.

    You should be filing on the day you become aware of no work, no pay. You lose money for every day you delay because your waiting period starts on the day you file.

    You don't need anybody's consent to file.
