    Default How to Prepare a Shared Parenting in Ohio

    My question involves a child custody case from the State of: Ohio

    My wife and I are hoping for a quick dissolution.

    She has moved out and is staying with a friend. The closest route makes it a 23-mile drive from the home I'm in with the kids.

    She has not yet found an apartment, and due to finances she probably won't be able to for another few months.

    Can we file a shared parenting plan while she is living with her friend using that as her address?

    If not, can we file a parenting plan now and modify that into a shared parenting plan when she finds her own place?

    Edit: Regarding distance, I found this in the law as one of the factors the court will consider to approve shared parenting: "The geographic proximity of the parents to each other, as the proximity relates to the practical considerations of shared parenting;" http://codes.ohio.gov/orc/3109.04

    Is it just up to the judge's discretion then? If so, anyone have any idea if 23 miles is too far?

    23 miles likely isn't too far. How old are the kids?

    Why does her address matter to whatever shared parenting plan you agree upon? If you do not care about the 23 miles the judge will not care about the 23 miles either. Just agree on a plan that the two of you think is fair.

    I didn't know whether the court would approve it based on the geographic proximity of a temporary address. Of course, maybe the court won't ask whether it's temporary or not.

    I'm OK with the 23 miles.

    The judge will approve virtually anything that the two of you agree to. Anything extreme enough to potentially be illegal or seriously bad for your children might not get approved, but pretty much anything reasonable will.

    Tough ages...you and mom are going to need to be prepared to be flexible. Your 17 year old will age out of custody orders when he/she turns 18, and the other two are old enough that they will want some say in their day to day lives. I am not saying that you need to let them control the situation but between friends, school, eventual part time jobs etc., they are going to want to be able to do what normal teens are able to do. The divorce is going to be a big enough upheaval, you don't want them to feel like they have absolutely no say at all in what else happens in their lives.

    That's good to know. The worksheets seem pretty straightforward. I think we can do this without an attorney. We're cooperating in all aspects encountered so far.

    I believe support in Ohio extends to high school graduation, or until the high school student is 19. Is that correct? She's currently a junior.
