    Default Divorce Custodial Parent Move

    My question involves a marriage in the state of:New York

    If there is nothing explicitly written in the final divorce agreement, are there any default restrictions on the custodial parent moving (with two children)?

    Thanks for any advice.

    In New York, if relocation is not addressed in the custody order, the parent seeking permission to relocate will need to petition the custody court for permission to relocate with the children.

    If you're the non-custodial parent, you should not assume that the other parent will go to court before moving, and should be prepared with a petition of your own in the event that a move occurs without court permission. You should discuss with a lawyer the chances of a court granting a petition to move, as well as whether the court would excuse and allow the relocation if it occurred without permission.

    Actually, I'm the father of the custodial parent (my daughter) who we think is contemplating a disastrous move with our grandchildren. Can I pursue this or would it have to be done by her ex?

    You have no rights to her children therefore of course you cannot pursue anything.
