    Angry Child's Last Name

    Child was born in Maryland in October 2006

    The certificate for the birth record was filled out by my fiance. He filled everything out and turned it in without my knowing. I had a c-section and a very difficult recovery, so I was out of it for several days after the surgery. We have now split up and my ex gave our son his last name, although I wanted him to have my last name. I did not sign the birth certificate and the father is also not listed on the birth certificate. I never gave permission for my son to be named after his father. Is this legal? My son is 5 months old now and I want this to be changed. What can I do? I am pretty sure my ex will not sign a document allowing our son's name to be changed to my last name. But everything I have read says the mother has the right to name the child anything she wishes. But he went behind my back completely!!

    How did he give the child his last name? You mean, he filled out the application for a birth certificate with the child's being named after him, but didn't put himself down as father, then submitted it without your signature? And the child presently has no birth certificate?

    If it did happen that way, all else being equal, they shouldn't have processed the paperwork.
