Hello. I was doing a search looking for information on suing my former landlord and was shocked, okay not really, to find this thread about MBS. That's who I want to sue! I no longer live in Texas, so this makes it much harder. I moved out at the end of April last year when I had ONE MONTH left on my lease. I paid in person through May 1 and when I left the offices were not open so I put a check in the mail for my May rent. Essentially I paid out the rest of my lease; however I DID give them 60 days notice and had a form signed and everything. Typically under their homeowner's addendum (I had bought a house out of state) you pay 85% of one month's rent (a reletting fee) and one month's rent (hence the 60 days notice); however I only had ONE month left on my lease, so they said to pay out my lease. It was no skin of their back, I would have left at the end of my lease regardless. They had an extra month to get the place ready. Anyway, a couple of weeks later the check was returned to my new address as REFUSED (I sent it certified mail). I was really confused. I called the property and I couldn't get anyone on the phone who knew was was up. I never got a call back. I sent another check via regular mail and the check was never cashed! Really bizarre right? Then I closed that account because my bank didn't have branches in my new state. I sent a NEW check from my new account and they still haven't cashed it! I have called, written letters, nothing. THEN I started getting collection letters from some firm in Dallas demanding $1,700 (my rent was $850 a month). I called them and said it must be a mistake and explained what happened. These people were MEAN. They said I had to pay the amount in full or they would sue me. I wrote a debt validation request and they just sent a copy of my lease. I filed a complaint with the BBB and they also just sent them a copy of my lease. A good friend of mine went to their offices in person and they said I had to pay $1700 for breaking my lease. I sent him copies of all my forms and everything and they didn't care. The manager said they had "rewritten" my lease and it was originally supposed to go until the end of July--this is a TOTAL lie. I have a copy of my lease dated in APRIL 2005 AND I had copies of my checks showing I started paying rent in April, not July. I have all the evidence to prove my case. I said I would pay the $850 if they would remove the negative marks on my credit report and they said NO ... they would NOT accept $850. They would ONLY accept $1,700!! I am going crazy. I need help with this. Any advice??? My credit is RUINED ... and I mean ruined, my score is 547. I am actually selling the house I bought and I need to get this cleared up so I can get approved to rent some place. I need help!
