    Unhappy Lawyer Screwups and Unprofessionalism

    I'd like to thank everyone for a great forum. Tho, i'd like to ask everyone here, injured workers and lawyer alike about help in my situation.

    My case: Takes place in Elkton, Maryland, .

    I was a truck driver that just got a new job at a food hauling firm. On my third day, the trainer placed 700 pounds worth of frozen meat and fish on a hand cart without a handbrake to take down the ramp. I did so, and the cart pulled me right off my feet, falling 5 feet down, and landing flat on my right knee, fracturing it in 2 places.
    I arrived back at home after work, and went to the hospital on my own accord that afternoon, where I had xrays done. Extensive bone bruises and 2 fractures.
    The next day I seen the WC doc for the company and he disregarded the x rays and ORDERED me back to work that night. I went in to work, and one week later, a box of frozen potatoes fell on my injured knee, injuring it, and spraining my ankle as well.
    Went to WC doc again, who ORDERED me back to work again, and when I protested I couldn't even walk, he yelled at me and said i had to make a choice. He sent me back to the offices of work, where I was dismissed since they had no light duty for truck drivers, and that I was afraid of using the ramps.
    whatever gave them that idea, ya think?

    Well I was forced to resign, after signing a letter saying I no longer work for the company, and the company would not give me my final cheque until I signed the letter.

    I hired an attorney who did file one claim for my knee injuries with the WCC (worker's comp commission), then after a few botched attempts at getting paid my wages, I hired a second attorney who was supposedly the best in Maryland.

    After hiring my 2nd attorney, I had received my claim letter from the WCC saying the insurance company is ORDERED to pay 2/3 of my gross wages since my injury. I shown my attorney the claim letter, and he scoffed, saying they do not have any weight behind them to make the ins company pay, and that i'd be better off wallpapering my room with the claim forms.

    He has refused talking to me at any lenth and ordered me not to call his office at least 45 days after I was evicted from my apartment. I am beginning to think that he was conspiring with the insurance ccompany to not get me paid, to starve me out, and give up.

    Since then, I lost my home, my jobs, my belongings, and on brink of loosing my wife and daughter, and my health. I had to stay in a homeless shelter for 3 months till in October I fired my second attorney, and hired my current attorney to take over the case.

    Now the problems.... my second attorney is REFUSING to furnish my new attorney with all the forms due to my case. @nd atty has avoided any and all calls from me and my attorney to meet, and even promised to meet us, and not showing up when promised. It was six months since I fired my second attorney, and he apparently wants to completely screw my case.

    I don't know if he is doing this to 'get back' at me for firing him, or that he is angry at getting fired.

    I am now fully disabled with my knee rated at 100% bad from injuries not healing. I now suffer from Anxiety Depression Disorder, and take Lexapro from my visits to the mental health facility for treatment. I cannot walk well anymore, and worry about my case falling through. I am ordered not able to work anymore, due to my deteriorated knee and mental depression.

    I have an award 463 dollars payable since march (70%) and added 20% on top of that for late payment, equaling 90% of wages, equaling 630 dollars a week since march 23rd.

    The insurance company swears they were paying me, but has not offered me copies of my cheques, because I do not have a bank account anymore. I could not endorse cheques i never received.

    Is there any recourse at all I can do, to get my case settled? What can I do to get the 2nd attorney to provide the necessary forms, short of arresting him, and filing a civil claim against his firm? He is one of 3 owners of the firm.

    Pain and suffering? Anything else I can do?

    All comments will be answered as well as I can.

    Workers Compensation is regulated by state law. The insurance providers are certified by the state and are governed by state law.
