    Default Is it Legal for Your Ex- to Open Your Mail

    My question involves criminal law for the state of: Idaho

    Can you sue someone for opening your legal mail documents and then using the other party as a way to harass me and make false allegations?

    I had a legal document mailed to me in Idaho after I left my husband for repeated abuse and threats. My ex had mailed documents regarding a child custody and child support case that he had against me. He has been accusing me of kidnapping for close to 10 years yet has made little to no effort to see the child.

    My husband took it upon himself to open the mail and then contact the ex and tell him that I was abusing the child, that I was doing drugs and had been hospitalized for trying to kill myself, and CPS had investigated me twice. CPS came because of my husbands accusations against me after I told his family he threatened to kill me and was an alcoholic. Instead of admitting his faults, he threw me under the bus and made me out to be a crazy person. CPS concluded that all accusations were unfounded. He still he threatens to hurt my relationship with my children and alienate me and told me he would ruin my life. After slandering me, my husband then offered to stand as a witness to these claims.

    None of these claims are true and I would be willing to take a drug test at any moment. The CPS reports are there but are unfounded. I have a witness that admits that he had convinced her that I was a bad mother to get her to call CPS. The hospital records simply do not exsist.

    My husband believes if he can get one child taken away that he would win custody of ours. He has laughed about this many times over the past year and I have always wondered what he would try to do next. I did leave him to protect my kids and I from his abuse.

    Can I sue him for opening my mail and then using it to slander me? What about him trying to get involved with this child custody case with flat out lies? Is this even legal? Please help.

    You are free to report your belief that your ex- received and opened your mail to the police, and see what (if any) action they believe is warranted. You may also discuss your concerns with your lawyer.

    If someone is opening your mail and reading the contents, contact your local postal inspector.

    Document everything.

    Sometimes that means calling the police when something illegal is happening or there is abuse.

    This will all help you in the future. There is nothing wrong with letting someone know what he is doing and it is for the best interest of you and your kids and your safety. The bs has gotta stop somehow.
