    Default Burglary of a Home After a House Fire

    My question involves criminal law for the state of: Mississippi

    My home burned but there was still a few things I could salvage, like my tv. When I went back home to start cleaning and see what was left after the fire, I found my home burglarized. The tv was gone along w/other things.

    I knew who did it (dope head). When I confronted him he admitted he stole it. I went to his house to get it and told me I couldn't have it. I was not going to argue about it so I got in my car to leave, and next thing I see is him coming out the door with a bat in hand, threatening me. I went back to my house and called law enforcement. After deputy got there, the thief brought my tv.

    He refuses to give back the other property he stole so I was wondering what would be the criminal charges on the tv? Is that a felony? Any time for that? (ballpark figure?) This may be his first offense, since his grandmother paid his way out of drug charges a couple years ago.

    Maybe I should file a civil suit for the vandalism.

    He's been stealing my mail. I plan to report that as well.

    What is the "used" value of the TV.

    The tv was $1200 new, about two years old. Not sure of used value.

    This is not his first charge of vandalism. He was convicted as a juvenile, but aren't those sealed?

    $500 and up is grand larceny, a felony that could get him up to 10 years and/or a fine of up to $10,000.

    Though I suspect since you got it back that the authorities might not prosecute.

    Might help if you can document other items that he has that belongs to you.

    Might also help if they charge him with vandalism or B&E in addition to the theft.

    No way to predict. You know your local situation better than I do.

    A civil suit against a doper criminal is likely to be a waste of time.

    Yes, but depending on the circumstances, they might be held against him.

    Again, no way to predict whether your local authorities are going to come down on him, or to what extent.

    Ok, thank you so much.

    This is a very small town so LE knows who he is. He even threatened to go to IA on one of them, citing harassment. LE wasn't harassing him, he's a thug and they know it.

    He was also trespassing (which they charged him with). I had to call law enforcement 9 times in a three week period last February. It is well documented that he was not to come back on my property. So that should have an impact, I would think. Can I ask the judge who hears this case for a restraining order since he is violent and has threatened my life?

    He also stole my mail and is under investigation by the USPS.

    He began his criminal activity when he was 12 years old. He vandalized a house.

    I'm sure you can. But there is likely a court procedure to follow and proper forms to fill out.

    Go on to your local court's website and see what you can find out.
