City Tree Planting Requirements

My question involves real estate located in the State of: California

A city tree in front of my house was uprooted by a windy storm.

Now, I got a letter from city of San Jose asking to plaint a 15-gallon october glory red maple tree.

Should the city be responsible as I did not cause the tree to fall? Or can I put cement on the spot instead?

Are they asking you to do the planting?

I would assume if it is in the city's right of way that they will replant whatever tree they wish.

Yes, they ask me to plant the tree. Otherwise, they will do it, and charge me $400.

I'd probably raise a stink about that. As long as it was in no way your fault the tree fell, it shouldn't be on you to replace their tree.

That would depend on what the city ordinances say.
