    Default Former Federal Employee Based in Ca- Final Paycheck

    My question involves labor and employment law for the state of: CALIFORNIA

    Hello, I voluntary resigned from the USDA on 2/22/2017. I mailed back all my equipment the following day and paid the balance on my govt CC.

    According to HR they are still in the process of "checking out" my items.

    Does the federal govt need to issue my pay check within 72 hours? California state law states that I am also due for waiting time penalties.

    The HR person stated they do not follow CA law, even though I live in CA and my reporting office is in CA.

    Just wanted to get some clarification.

    You quit mid-pay period. The pay period ended 4 Mar; you will receive your paycheck on the regularly scheduled day (which should be this week). Federal law is going to take precedence.

    The federal government is not subject to state labor law so the time frames in the California statutes will not apply. It is the federal civil service rules that determine paycheck processing. Generally speaking, the federal government will process your final pay like any other, so you will get that on the same scheduled pay day as you would if you were still working there. I have left federal employment twice, and that was what occurred each time. The federal government doesn’t generally speed up your final paycheck.
