    Default I think I have a stalker

    i need a little advice on how to get the county sheriff to help me with this man who for 12 years have harrassed me broken in to my home and has tried to phyiscally harm me. last july he hit me head on. i was a astop when he came down the road and hit my truck head on the only thing the cop did was issued 2 tickets. while we were standing there i tol the cop i have a RO on this guy but he wouldn't do anything about it. this then went to the courts and tried to get a RO on me and i showed the judge where i already had one on him and i also showed all the police reports of him breaking in to my house, breaking windows in my house,killing my dog,shooting holes in the side of my house. this guy is nuts. well the other night my dogs were barking so i get out of bed to see why and there stood this guy in my yard again i called the sheriff and they still have not shown up it's been 3 days now. what other steps can be taken. can i filed a civil suit or small claims for damage done to house can i get money for harassment
    any suggestions

    Default Violation of Restraining Order

    If you have a restraining order, and this person is violating the order, your best approach may be to petition the court to hold him in contempt.

    It is peculiar that the County Sheriff isn't helping. Have you made any inquiry with supervisory officers about why they won't enforce the court's order?

    I have spoken with everone at the sheriff's office until im blue in the face. he did spend 6 month's in jail a few years ago but it has only gotten worse since he has been out. this guy sued the county where we live. and they have pulled him over several times for dus but he keeps getting away with just fines. i have personally called the judge about this and he said he would look into why the sheriff has not brought him in. i have not gotten a response from him yet either. i guess i need to get an attorney to look in to this matter as to why they are letting him get by with breaking the RO as i am typing the guy in out in front of my house walking back and fourth and has no reason to be here since i live at the dead end of the road. this really sucks because i can't go out in the yard. i am trying to find out if i can file a suit against him for harassment or stalking.the list of things this guy has done to me goes on and on. and it is all reported. when i caught the guy in my house the only way i got the sheriff out here to tell them that if they are not here in 30mins i will put a bullet in him then they can send an ambulance (i don't own a gun but i am considering) but they did finally show up. and when they went to his camper found some of my personal belongings (undergarments) which had his dirty deed in them (wouldn't that be like a sex crime?

    Actually, if they are not there within 5 minutes of your call, you can sue the county, city, and police department for enough money to leave the state and never have to work again, ever. There are lots of lawyers out there who would love to have a 35% cut in your winnings just for letting them have your case. Remind the police that the RO is in violation and you think he will kill you if they are not there within 5 minutes, someone will have to pay because your gonna sue and win millions of dollars basically bankrupting the county and city theirfor people will loose their jobs because there will be zero dollars in the budget for police. ok, ok, i believe there is a law called melonies law or something similar because the person violating the RO killed the person and the family won millions of dollars lobbied for a law stating the 5 minute rule. I believe most states have adopted this rule so consult an attorney and sue the city, county, police and this creep all at once all as the deffendants in civil court. Make them pay for not doing their job (or stalking) you.

    What?!?!

    In WHAT state does THIS happen? (My guess is: None.)

    In my county the average response time is well beyond that 5 minutes due to sheer distance! If this were the standard, most police and sheriff's departments in CA would be in court each week.

    Please cite some state law or case law that shows this to be the case anywhere.

    I would enjoy this citing as well, if so I'll have to think of more reasons to call the police.
