    Default Can a Funeral Home Demand Payment from Family Members

    The director of a funeral home has sent a letter to the family members of a deceased person, stating that the person who signed the contract for the funeral has not paid the bill. The letter states that if the family does not pay the bill, they will be taken to court. He says that they are responsible because they attended the funeral, even though they didn't sign a contract. Is that true, in Pennsylvania?

    The funeral home can try to collect the money from the person who signed the contract, or from any other person who guaranteed payment. If not paid, it may submit its bill to the probate proceedings as a creditor of the estate. If no estate is opened, it may be necessary for the funeral home to commence estate proceedings to try to collect the money that is due from the decedent's estate, assuming it has assets.

    Merely being related, or attending the funeral service, is not enough to create liability. The debts of a decedent and the estate are not inherited.
