    Default When You Self-Petition Under VAWA Do You Need to File a New I-485

    A woman married a U.S. citizen who filed an I-485 on her behalf, to get her a Green Card. She has since left him before their interview, and has filed for divorce due to domestic violence.

    She is self-petitioning for permanent residency under VAWA. Can she rely upon the I-485 filed by her husband, or does she need to file a new I-485 for the VAWA case?

    The VAWA petition is separate from the petition filed in association with the failed marriage. It is thus necessary to file a new I-485 in association with the VAWA petition.
