    Default How to Get My Son to Move His Mobile Home Off of My Property

    My question involves landlord-tenant law in the State of: Maine I gave my son a mobile home that we both were living in when my new home was finished being built. It has been 3 years now and the town wants the mobile home removed from my land also I am putting my home on the market for sale in the spring. I have asked him man times to please move the mobile home and he tells me when his income tax comes in he will but that does not happen. He moved out of the mobile home in April of 2016 and he told me again that he will move the mobile home when his income tax comes in. Well his income tax has come in and he is spending money left and right and when i remind hime of the mobile home beong moved in the spring because of snow he can not move it now he will say i know or he wont say anything . Long story short i would like to know if i have any rights on selling this mobile home because i can not afford to have it moved in a trailer park and also pay lot rent when my house sells, any advice would be greatly appreciated. One more thing he has never been charged any lot rent by me.

    When you say "gave it to him" did he retitle it into his own name?

    The taxes come in his name but the taxes are behind and the tax collector told me there could be in issue on the trailer and my land where it sits on unless the taxes are paid. I don't believe he ever went and had any title papers done.

    But did you sign over the title and hand it to him?

    That's important.

    Go to the DMV ASAP, tell them your title is lost and you need a duplicate. You'll find out quick enough whose name is on the title. If it's you, buy a duplicate and go ahead and sell it and pay off your taxes. You take your chances on having trouble if you do that but if he squawks after it's gone you can probably buy off any problems before they come your way.

    If it's his name on the title, treat the mobile home as abandoned and get the advice of an attorney as to how to get rid of it.

    Meantime, I'm not sure I would trust the tax collector's statement about your land being at risk. He may just be trying to scare you into paying. Find out for sure by consulting a property tax expert.
