    Default Who is Liable for Fence Damage from a Fallen Tree

    During a hurricane, a perfectly healthy tree was blown over and fell on a fence owned by the neighboring property. The tree owner performed a small amount of work to help remove the tree from the neighbor's land, but says that removing the lumber and fixing the fence are the neighbor's problem. Who is liable for the cost of cleaning up the debris and fixing the fence after this type of so-called "act of God"?

    When a healthy tree falls in a storm -- the "Act of God" you mention -- the burden of clean-up and fence repair usually rests with the owner of the fence and property. Homeowner's insurance may provide coverage for the clean-up and fence repair.
