    Default What Will Appear on a NCIC Check for a Government Job

    My question involves criminal records for the state of: Texas

    Hi everyone,

    Forgive me if I am coming off as sounding naive (I am) with a minute understanding of the law, but here is my scenario and question:

    When I was a 15, I went into a program voluntarily. After being there for a month or so, I realized that I had no reason to be there and wanted to leave. My mom wouldn't let me go, so I ran away from the program and went home the next day.

    I think it's safe to assume that a missing person's report was filed, but even my mom said that she didn't think so. I never went to juvenile court, talked to the police or anything else. I talked to a counselor a few times, and that was it. This happened in 2001. Once the agency reported me as found, what happens to that file? Would it show up on background check even though it's been 16 years?

    What kind of program was this and why were you sent there in the first place?

    It was a drug rehab program, my mom freaked out when she caught me smoking pot with a friend.

    Ok, then it was a program that your mom voluntarily put you into, and then chose to not make you go back after you turned up at home. I am sure that she told them that you had come home and were no longer missing.

    The only thing that should show up on an NCIC report should be law enforcement contact that resulted in arrest and/or criminal charge (not all criminal charges result in arrest and not all arrests result in a criminal charge). What you are describing should not appear.

    Sorry, JBD but that's INCORRECT. Missing persons and runaway reports are definitely in the NCIC database (along with a bunch of other things not based on criminal charges like people subject to protection orders, suspected terrorists, ... that all fall short of arrests or charges). Whether this report, had it been submitted to NCIC< remains there after he was determined no longer to be missing, is another story.
