    Default Can You Pay Debts Outside of a Chapter 13 Plan

    If you file for Chapter 13 bankruptcy, but have a car loan and home mortgage for which you have never been late in your payments, is it possible to keep paying those loans outside of the Chapter 13 repayment plan or is it necessary for them to be included in the plan?

    Depending on the jurisdiction, with payments being current, it may be possible to continue to pay the mortgage and car loan outside of the plan. However, there are a number of factors that may affect the borrower's ability to repay the loans outside of bankruptcy, and thus this is a question that should be posed to a bankruptcy lawyer. There also may be an advantage in including the loans in the repayment plan, and the bankruptcy lawyer will be able to advise the debtor on the pros and cons of each approach that is available.
