Exactly. There are are a large number of potential conversations that might occur in a store, a number of which would not be public. For example, a discussion between the manager and an employee in the manager’s office in the store would not be a public conversation even though it took place in a store. A conversation between two employees in the corner of their break room similarly is not going to be a public conversation even though it took place in a store. A discussion between customers in the store bathroom similarly is not a public conversation (and indeed even video in the bathroom would be a problem.) Even some conversations between a customer and store employee are not going to be public. The exact details matter. This is why most stores do only video recording, not audio. (And do not record the video in any place where that is inappropriate, like bathrooms and dressing rooms.) There is too much risk that the store might violate the law by illegally recording a private conversation. That might be dealt with in at least some situations by very conspicuous signs notifying customers that their conversations may be recorded, but doing that may well drive away customers.
