    Default Can an Employer Publicly Reveal Your Background Check Results

    My question involves labor and employment law for the state of: FLORIDA

    I had a leve; 2 FBI background check for teacher certification. I was honest about there being blemishes on my report. Once received, they asked me to send all court documents and a personal affidavit. None of the offenses related to the teaching career nor children and my certification was granted with probation. After granting my certification, it is now available to be checked and verified publicly. Also on the state department website, you can search any teachers name and see if any disciplinary action has been taken out on a teacher. Not only does it say yes, but it lists each one of my offenses, the arrest, the charge, the disposition, etc all on the public page. It seems nobody need do a background check on me anymore, Florida posted all of my offenses publicly for the whole world to see. I knew that they would use it to determine my certification and possible employment, but I did not know they would air this to the entire world. Is this okay? I see that it has been done to countless others as well and for years. Is there anything I can do to get them to remove it? I'd honestly rather not have the certification that to have this out there.

    Are you asking if the Florida Dept of Education can take the public records regarding your criminal history and attach them to a public profile attached to you public school teacher profile? Yes, they can. They can and did.

    You couldn't figure that out before you applied for a certificate?
