Default What to Do if You Can't Complete Community Service Due to Illness

If you become ill during a period of unsupervised probation, and won't be able to complete your community service on time, what should you do? The defendant, who is in California, is under a doctor's care and is presently totally disabled.

Default Re: What to Do if You Can't Complete Community Service Due to Illness

The defendant needs to petition the sentencing court to either extend the sentence to permit the defendant to complete the community service once sufficiently recovered or, if the disability is long-term or permanent, to try to get the court to modify the community service requirement based upon the defendant's inability to complete it. The defendant would benefit from working with a criminal defense lawyer, and will need clear documentation of the disability and possibly also testimony from a qualified medical professional.
