    Question Witness to home invasion

    i am a witness to a hom invasion in MI. i noticed the crime, called 911, even tried to chase the 2 guys. i am 5'1" 120lbs, what am i going to do with 2 robbers? dumb, i know.

    Anyways, i want to make sure that these to people ae put in jail. i have been told that a felony is minimin of 5 years, is that correct? the charge is 2nd degree home invasion, in Michigan this is a felony. what is the difference between 1st and 2nd degree? also, what is the diff between home invasion and a B and E?

    i watch way to many court TV shows so i am trying to make sure the cops do everything they can to convict these people.

    the victimes home is my neighbor and best friend. we both work our butts off everyday to aford our home and everything in it so i am angry that someone has the nerve to just take someone elses belongings.

    one day i am thinking "i love my house, neghbors, neighborhood, city" the next i am like "i am out of here, sell the house, forget it,give it away!"

    can you tell i have some passion behind this? lol

    please help if you can. i have no idea what to expect when going to court as well. Thank you

    The police don't convict people. The judge and/or jury convicts people. The police collect evidence and build a case. Once that is done, it's out of the "cops'" hands.

    sorry maybe a bad coice of words.

    What i meant by that is that i want to make sure the cops do evything they can to provide the prosicuter with the strongest evidence so there will be a better chance of getting a conviction.

    I'm sure the police took your statement. You may be called to testify at the preliminary examination. If the case goes to trial, you would likely also be called as a witness at trial. There's a substantial chance that the charges will be resolved with a plea bargain.

    Michigan's "home invasion" charges relate to burglary-type offenses of occupied dwellings. You can read Michigan's burglary-related statutes here, and the home invasion statute here.

    (3) A person who breaks and enters a dwelling with intent to commit a felony, larceny, or assault in the dwelling, a person who enters a dwelling without permission with intent to commit a felony, larceny, or assault in the dwelling, or a person who breaks and enters a dwelling or enters a dwelling without permission and, at any time while he or she is entering, present in, or exiting the dwelling, commits a felony, larceny, or assault is guilty of home invasion in the second degree.

    (6) Home invasion in the second degree is a felony punishable by imprisonment for not more than 15 years or a fine of not more than $3,000.00, or both.

    may i ask where in michigan did this happen?
    my boyfriend and his best friend broke into an abandoned house in michigan and it counts as a home invasion 2nd degree and im wondering if it happened in the same area.
