    Default Do You Have to Attend an Asylum Interview if You Already Have a Green Card

    A Syrian citizen entered the U.S. as a refugee, and is scheduled for an asylum interview. However, since his admission he has married a U.S. citizen and has already obtained legal permanent residency through his marriage to the citizen. Does he still need to attend the asylum interview, or can he cancel the interview based upon the fact that he already has a Green Card?

    If you seek adjustment of status based on marriage to a U.S. citizen, you should not withdraw your asylum application before that process is complete. To do so would put you at serious risk if your marriage-based petition is not granted. However, after you successfully adjust your status based on marriage and become a LPR, you may withdraw your application for asylum.
