    Default Can a Hospital Employee be Fired for Looking at a Relative's Medical Records

    A hospital employee in Ohio was fired for looking at her daughter's medical records. The daughter has had a lot of medical problems, and her mother was checking out what was happening. The daughter doesn't mind that her mother looked at her records. Is that a proper basis for termation?

    She can be fired for looking at the medical records without a proper release, or even if the daughter gave her permission beforehand but the access occurred in violation of hospital rules. It sounds like the daughter is trying to give retroactive permission to save her mother's job -- as they say, you can't unring a bell. The hospital has to follow HIPAA requirements for medical record privacy, and it is not unusual for this type of violation to result in an employee's being fired.
