    Default Can an Employer Discriminate Based On Union Non-Membership

    In Missouri, is it legal for an employer to give different wages to union and non-union employees? If a union contract requires specific annual raises to union employees, is it legal for an employer to give non-union employees smaller raises or no raises at all?

    The union contract is between the employer and the union members. If somebody works for the same company but is not a member of the union, that person does not benefit from the union's collective bargaining agreement -- they have their own, individual contractual relationship with their employer. They are responsible for negotiating their own wages and their own raises. It is not unlawful for the employer to pay them less money than they might make as a member of the union.
