    Default Should Commissions Include Service Call Fees

    Commission-based employees in Tennessee work for a company that performs services for clients on-site. When an employee is dispatched to a customer's work site, the customer pays an additional fee for the service call, but the employee's commission is based only on the charge for the work performed. Shouldn't the employee's commission also include a percentage of the additional service call fee?

    As long as the employees are being paid at least minimum wage, the employer has no obligation to pay them more or to share any additional fees with them. If the commission does not include the service call fee, there is no legal basis to require the employee to pay an additional commission based on that fee.
