    Default Advice For Parents Seeking Joint Custody

    Me and my wife are borderline at a divorce at this point, we have 3 children together and she has a child when I met her. We live in Florida.

    What is most important to me is spending the time with my kids and I want to try for joint custody and I want to know what is the best way to prepare myself for this for the courts?

    I love my kids just as much as her, she already stated she would go to work again if we split so she would be in the same boat as me and use day care for our youngest so the argument of she would be able to spend more time of them does not seem to tilt in her favor here.

    On the other hand my job allows me to modify my work hours to where I could use joint cutody and actually have 3-4 days off a week to just spend with them.

    And to also throw a curve into this, my stepdaughters father had not paid child support in over 10 years, he was killed and had an estate coming to him, there was a judgment placed against the money going to him and now we are waiting on $85,000 in back child support to be paid to us.

    Is any of that portion to be given to me since I was the only working during our marriage and I paid the support for the child or does that all go to my wife?

    Please help, I want to make sure I am covered as much as I can.

    Sorry....the back child support is owed to your wife. It has nothing to do with you and you have no claim to it. Good luck with your case. You seem to be in good position for at least joint custody. I LOVE seeing fathers that are eager to spend time with children and take responsibility for them.

    You do realize, however, that you may not be granted visitation with the step-daughter unless the mother agrees to it.....unless you adopted her.
