    Default Can You Sue Somebody for Nonpayment of a Personal Loan

    If you loan somebody money over a period of several months, adding up to roughly $10,000, then they fail to pay you back as agreed, can you sue them to collect the money, in California? The lender has bank records showing the withdrawals, but there is no written loan agreement or promissory note.

    Yes, you can sue over a personal loan even if it is poorly documented, and for that amount you can sue in small claims court. Ideally the other person will admit to receiving the money as a loan; issues of proof will become complicated if they deny receiving the money or argue that it was a gift.
