Default Re: Removing an Attorney Fee Provision from a Divorce Judgment

If the dollar figure is a blank, I would give the lawyer the benefit of the doubt -- that he accidentally included a boilerplate paragraph that can be stricken from the proposed judgment.

The man can assure his wife that he will not be seeking legal fees, and can instruct his lawyer to remove the paragraph from the judgment.

If under the retainer agreement for the divorce proceeding, the fee is a lump sum that has been paid in full, the attorney has no basis to seek additional attorney fees from anyone for the completion of the divorce.
