    Default Removing an Attorney Fee Provision from a Proposed Divorce Judgment

    A disabled veteran wanted to file for divorce, and he found a lawyer who gave him a break on the legal fees. The lawyer charged a lump sum fee and was paid in full.

    As the divorce nears its conclusion, the man's wife has objected to language in the judgment that recites that she should pay a portion of the man's attorney fees. No amount is listed, just a blank space, but she wants the entire paragraph removed from the judgment.

    The man didn't ask his lawyer to include the provision. Can he get his lawyer to remove the language? Is the lawyer possibly trying to get additional legal fees from his soon-to-be-ex, to make up for the discount?
