    Default Will a Criminal History Affect Your Application for Citizenship

    Hi, I have few questions like to ask.

    1) why applying for citizenship, do they only go back to last seven years of criminal history or there is no limits ?
    2) if you got arrested and didn't serve any jail time and you paid your fine and restitution, are you still eligible to apply for citizenship ?
    3) Felony means you server jail sentence ? I guess what im trying to ask here is, if the sentence was probation and pay restitution, does that disqualify me to apply for citizenship ?
    4) If I still on probation, can I renew my permanent resident green card ? any chance I could be deported ?

    These are questions to ask your attorney.

    For what it's worth though, actual time served/punishment typically isn't as important as the potential sentence the crime carries.

    There are no limits to a criminal record. For naturalization purposes, it doesn't even matter if you were expunged or Donald Trump hisself gave you a pardon. It needs to be reported on your application and it will be considered. It would be stupid not too anyhow, since the CIS is already well aware of your moral turptitude.

    Even if you don't serve jail time, it can be grounds for refusing citizenship.

    Felony means the crime is defined as a felony. Absent the state characturizing things as a felony (a few states don't make such distinctions), the feds will consider any crime that has a POSSIBLE sentence of over a year to be a felony.

    You can renew your green card while on probation. Your chances of being deported are not affected by this. Frankly, you're well on your way to deportation as it is as near as I can tell. The fact your wife filed an I-130 doesn't wipe out the fact that the existing order is in process.

    I was given 10 years of green card and it will be expire next year 2018 in June. I know I probably can't apply for citizenship but can I still apply for renew green card ?
    my sentence is 3 years probation and fine. I'm still continue to making my restitution payment with no delays.

    will they not grant my renew green card and deport me ?

    Considering the actions of the current administration, I would (if I was you) be seriously prepared for the worst in terms of renewal.

    What you are experiencing is extremely common for people who have been on the wrong side of the law and dealt with the consequences; know you aren't alone and many have been where you are. Don't give up the fight, acknowledge accountability and responsibility and it might help you gain confidence in moving forward with the good life, it did with me. If your income level and citizen status qualify, you may be entitled to mental health services through the government that can assist with your feelings of hopelessness and prescribe you medications to feel better. A trip to the department of human services in your local community may be in good order. Best of luck!
