    Default Refusal to Give Reference Without 30-Day Notice in California

    Hi,

    We're set to move into a new complex in mid-April (the current tenants are moving out at the end of March), have already filled out the rental application with the credit check and references, etc. Apartments are very hard to come by in the area, so we had to start early to ensure that we would have a place.

    The new complex is requesting renter history info from the current complex as part of the application, as expected. However, the current place refuses to give any information until we give a 30-day notice. We were planning on giving notice on March 30, since we'd be moving into the new place in mid-late April. They want us to give a 30-day notice now, which as far as I know, means that we'd move out by April 7.

    Without the renter history check, the new place can't finalize the application. Can the current complex do this? Can we give them a 30-day notice in advance (now) that's dated for March 30, just so they can disclose the info to the new place? Help on this would be greatly appreciated.

    You can give notice now that you will be vacating in April. Your notice can be for longer than 30 days....it just has to be AT LEAST 30 days. You will also have to give them a definite date. It is normal procedure for an apt complex to withhold a reference pending receipt of a proper notice of intent to vacate.

    Thanks for the responses. I'll just give 30-day notice now but date it for March 30.
