    Default How to Fight a Return Fraud Charge Over an Item Purchased on Craigslist

    A Missouri man purchased an item on Craigslist, and it was still in what looked like its original packaging. He took it to a Walmart for a refund. They gave him the money but later opened the package and found out it was empty, so they contacted the police. The man is now charged with a third offense theft charge, and the best plea deal offered so far involves a year in jail. How can he defend himself against the charge?

    Can he produce the Craigslist ad? Information about the seller? Proof that he paid the seller for the item?

    Seriously, with that as his story and with his having priors, it's not a surprise that the police and prosecutor don't believe him to be innocent. Unless he can come up with actual evidence that his story is true, he and his lawyer will likely have a tough job getting a significantly improved deal.
