    Default How Can a First Offender Get a Bond Reduction

    My question involves criminal law for the state of: Michigan. I have a 17 year old nephew that just got arrested on a Felony warrent that he was not aware of having.. The warrent happens to be for another County that is 127 miles from were we live he has no previous criminal history the judge set bond at 250,000 , 10% meaning we need 25,000 witch I think is responsible high for a 17 year old with no criminal history. I've read about a bond reduction hearing and the process to file one.. How long does it take to get a hearing for a bond reduction? Since he is a first time offender why is he not able to receave a P.R bond? Again he is only 17 , he has been incarcerated for 5days, being charged as a adult so he is in a jail..

    He can petition for a court-appointed lawyer, and ask that his lawyer bring a motion to reduce his bond. As we know nothing about his case or charge, there's not really anything more we can say.

    The bond determination won't be made based on his age if he has been charged as an adult. The bond is determined by how much of a flight risk he is. If the charge is serious enough, he could be held on a no bond status. But if his attorney can successfully argue why the court can be assured he will appear for trial, it could be reduced. As Mr. Knowitall said, the details matter.

    There is nothing you can do for your nephew except to get him an attorney.

    This has nothing to do with bond, but the good news in MI if you weren't already aware is they have a program called HYTA for juveniles his age. Certain offenses are excluded like sex crimes, but this program allows the juvenile, even if charged as an adult, to complete a period of probation and then have the charge dismissed with no public record of the offense. They may also want to send up to a program called boot camp instead of a prison term if its his first offense. Just something to look into, and perhaps provide some hope.

    If this kid has no criminal history, we're talking about a very serious criminal charge, and cannot assume that he's HYTA-eligible.
