    Default What Happens in Court After You Shoplift

    My question involves criminal law for the state of: Colorado
    My fiancé and I were struggling with money because my fiancé had lost his job. We really needed wipes for our son, so my fiancé had shoved them into our sons diaper bag while we were at Walmart. My fiancé also stole a few things that he needed by sticking them in his pockets. When we were leaving we got pulled aside and asked to follow the worker into a room. There were cops in this room, and the started searching my fiancé. After they searched him they then asked what was in the diaper bag, my fiancé told them he had put wipes in there, and they took the wipes out. We complied with everything they said, and since I was with my fiancé while he did the deed, and since I touched the diaper bag, I got a ticket along with my fiancé (even though I did not steal anything) and now we both have to go to court together. We didn't get banned from Walmart since we stole things we "needed" and since it wasn't headphones or anything like that. We have to pay 50$ each and have to both get something in the mail from Walmart to pay as well. I want to know what will happen when we go to court. This was his first time stealing and he got caught. He has a clean record and hasn't ever been in trouble, same with me, my record is squeaky clean. he didn't want to steal but we really needed the wipes for our son. What will happen? Will this go on our record and make it difficult to find a job? My fiancé just had an interview today and they said they will do a background check, will this affect his chances of getting this job? I read that we shouldn't plead guilty, and when we go to court should we ask for an attorney? Please I need help, I've never been in court, never been in trouble and I don't know what to do, same with my fiancé. We are clueless, and we will never steal again!

    As far as you not stealing goes, if you were a party to your fiance's theft (i.e., you were aware that he was stealing at the time he shoved the wipes into your son's diaper bag, and you didn't remove the wipes immediately and put them back on the shelf and then walk away from your fiance), then in the eyes of the law, you are as guilty of theft as your fiance.

    Yes, this will go on your records.

    Regarding your fiance's prospective employer's background check, it really depends on how deep a check this prospective employer does. However, if your fiance is hired, and then at a later date his employer finds out about this shoplifting spree, the employer will be legally free to fire your fiance, and to tell your fiance's future prospective employers (and anyone else who's interested) why he was fired.

    You both need an attorney. If you can't afford one, ask for a PD when you go to court.

    As an 'addendum': Nobody NEEDS baby-wipes. You can do just as well with a warm damp bath-cloth.
