    Default Mortgage escrow refund check error

    We recently received a refund for our mortgage escrow because the account was said to have been overpaid for the year.

    After phone verification that said check was valid, we cashed it.

    Now, a few weeks later we received a letter in the mail saying the check was in error, and we have to send it back, or, send them a check for the value, or it will be tacked onto the escrow as an added debt.

    Is it legal for them to claim this money was an error on their part after saying it wasn't? Can they legally do anything to remit payment after the check was cashed (and verified to be legit, albeit via phone). What recourse do we have if any?

    We reside in Michigan, as I'm sure local state law applies somehow.

    Default Bank Error

    The place where bank errors are most likely to end up being in your favor is within the context of a game of Monopoly. Banks have worked hard, and largely successfully, to ensure that their accidental payments or credits to customers can be corrected.
