Prosecuting a child is no easy thing. In NY it can be an involved process, and there will be difficulties proving that the child possessed the necessary capacity to even commit a crime. Under NY law it seems that prosecuting a child under 13 for most crimes can be a difficult matter.

It may be possible that the police forwarded a report to the prosecutor ... or, they may not have. You can contact the local police and ask to speak with a supervisor and ask if they have or intend to forward the matter to a prosecutor or not.
