    Default What Can You Do About Rude, Noisy Neighbors

    My question involves landlord-tenant law in the State of New York.

    My wife and I moved in 4 months ago and our neighbours upstairs are the loudest most inconsiderate people.
    A family of 3 or 4 people live upstairs, a man, a woman, and maybe one or two small children, I can't be sure exactly.
    They stomp all the time, which I could accept, but they are constantly smashing things on the floor, screaming, shouting, loud bangs CONSTANTLY, sound like a big table being flipped on its side or thrown, except this is nearly every day - I am not exaggerating. The child is always having angry uncontrollable outbursts and it sounds like a vert hostile and violent environment. For a long time I felt extremely uncomfortable, not knowing whether to call the services to keep someone safe, but in case I was wrong, and I didn't want to start trouble with these nasty, shady people.
    One day when I had visitors my ceiling was leaking. I called the Super, he didn't answer so we went upstairs to try to resolve whatever was causing the leak. They were clearly home because I could hear them, but when I knocked politely on their door they all went silent, and refused to open the door. Through the door, I told them there was a leak in my apartment and the mother aggressively told me to take it up with the super. I said I will but if they have any water running to please stop it, as the water was weighing my ceiling down. They were silent. I asked again if they had any water running, she shouted that she "had a bath ok, BYE"
    The super eventually called back and told us that they usually have problems with them and they have been trying to get rid of them for a long time but to no avail.
    So they don't pay their rent, possibly a dangerous environment and everyone seems to be afraid of them.
    What are my rights as a tenant who pays my rent?
    And if legally, there aren't many options, what else can I do? I just want this to end!

    There is, unfortunately, only one practical solution to that problem.

    Move.

    If the super can't get rid of them, there's a reason. Unless you're willing to fight what sounds like it's already a losing battle, adjusterjack really gave you the only answer.
