    Default Can You Beat an Unsafe Passing Charge if You Think That You Passed Safely

    If you are ticketed for unsafe passing under VC 21755, can you win a trial by written declaration if you believe that you passed safely?

    Is it possible to win? Yes, anything is possible. But if the officer writes a response indicating that he observed unsafe driving conduct, it will be your word against the officers, a formula that usually breaks in favor of conviction.
