    Default If a Father is Ordered to Pay Child Support Can He Change the Child's Last Name

    A child was born to unmarried parents in Florida, and has his mother's last name. Paternity was not established when the child was born. Now a child support action is pending. When child support is awarded, will that give the father the legal right to change the child's last name from the mother's to his?

    There will be no automatic name change upon entry of a child support order, nor will the father have any unilateral authority to change the child's name. If the father wants a name change he will need to petition the court for a name change and, if the mother objects, convince the court that the name change is in the best interest of the child.
