Default Why Would Continuous Family Violence Charges be Filed for a First Offense

A woman called the police about being abused by her boyfriend, the first time the police were called to their home, and he ended up charged with a felony for continuous family violence. Why would he be charged with that very serious crime rather than with a misdemeanor, if he has no D.V. priors?
