    Default Failure to Stop at a Stop Sign in California, VC 22450(A)

    My question involves a traffic ticket from the state of: California

    hi, I just got my first ticket for stop sign. Officer told me that i was not stop for 3 second on stop sign.
    when i reached to the crossing junction, i want to take right turn. so i 1st on my right indicator and went to right most lane and stop it for 1 second (because there are no other vehicle on crossing junction at that time) and took my turn.

    So am i guilty for this?

    If he says that in court, you should win. There's no requirement for any number of seconds. You just need to make a complete cessation of movement (this means that the weight of the car settles down on the springs, not just that you've locked the wheels) with your vehicle.
    Whether there is another vehicle or not is immaterial.

    Cali. Vehicle Code 22450(a) reads:
    "The driver of any vehicle approaching a stop sign at the entrance to, or within, an intersection shall stop at a limit line, if marked, otherwise before entering the crosswalk on the near side of the intersection.

    If there is no limit line or crosswalk, the driver shall stop at the entrance to the intersecting roadway."

    If the officers' only testimony is that you didn't "stop for 3 second", he has a problem because the statute does not specify an amount of time you must be stopped, it simply states that you stop.

    I suspect you may have misunderstood what the officer said. When you say you stopped for one second, I also suspect you think you stopped but didn't.

    In most stop sign violations, the driver hits the brakes and assumes they have come to a stop because they feel the car lurch forward very hard. They then drive on never having really stopped. Instead, they have made what is often referred to as a rolling stop or a Hollywood stop. You vehicle does not come to a full and complete stop until you feel the car lurch all the way back after it has lurched forward. Stand by a stop sign at a busy intersection and watch for five minutes. You will quickly see what I mean.

    What officers often "suggest" to drivers (and what you probably heard) is, once you stop at the sign, count to three before you continue. While not mandatory, doing that is a good way to ensure you won't be cited for running a stop sign in the future.
